Dr. Carhart stated that the Nebraska law banning so-called �partial-birth abortion� was unconstitutional, based on the �undue burden� test established in Planned Parenthood v. Casey.

The Court struck down the abortion ban on two grounds: the ban did not include an exception for the health of the woman, and the ban's language encompassed the most common method of second-trimester abortion.This would place a substantial obstacle in the path of women seeking abortions and would qualify as an "undue burden."
