Leroy Carhart (physician who
specialized in late-term abortion services) v. Don Sternberg (Nebraska State
Attorney General) - 2000
Dr. Carhart stated that the Nebraska law banning
so-called partial-birth abortion was unconstitutional, based on the undue
burden test established in Planned Parenthood v. Casey.
The Court struck down the
abortion ban on two grounds: the ban did not include an exception for the
health of the woman, and the ban's language encompassed the most common method
of second-trimester abortion.This would
place a substantial obstacle in the path of women seeking abortions and would
qualify as an "undue burden."
